Mapisa-Nqakula’s Request to Have Her Arrest Prevented is Denied by the Court.

The Pretoria High Court has denied National Assembly Speaker Nosiviwe Mapisa-Nqakula’s request to stay her incarceration.

After her Johannesburg home was searched and seized last month, she filed the application for the interdict.

Concerning the matter, the NPA is looking into claims that she took bribes when she was the defense minister.

The attorneys representing Mapisa-Nqakula informed the court last month that they had been unable to get a response to their questions on the investigators’ intended arrest date, so they were forced to file an application for an interim interdict.

Judge Sulet Potterill delivered the decision on Tuesday morning.

The applicant’s standing in society, an unlawful prosecution, an unlawful arrest, and an infringement of their constitutional rights to dignity and freedom of movement are the four main tenets of the applicant case.

The NDDP attests in the responding affidavit to this application that it will not object to bail. It’s not urgent to make an arrest. Clearly, this court does not have the authority to direct the minister and its representatives to summon the applicant instead of arresting her.”
