South Africa’s Request to Stop Israeli Military Operations in Rafah Will Be Decided by the ICJ Today

This afternoon, the International Court of Justice (ICJ) is anticipated to rule on South Africa’s plea that Israel halt its military actions in Rafah.

A week ago, South Africa gave oral arguments in front of the court in The Hague, Netherlands. It filed an appeal with the ICJ to change the temporary orders that were given in January of last year and this month.

The ruling stems from the request for arrest warrants for Israeli Prime Minister Benjamin Netanyahu, Defense Minister Yoav Gallant, and three Hamas commanders for war crimes and crimes against humanity made by Chief Prosecutor Karim Khan of the International Criminal Court.

“We’ve seen strong submissions by the South African delegation, with strong reliance again on UN sources,” states Dr. Atilla Kisla of the Southern Africa Litigation Center. The Israeli contribution sought to discredit the South African contestants by asserting that Israel had done nothing illegal under international law.

“It will be fascinating to observe the court’s actual handling of the petitions submitted by the South African delegation—particularly concerning the recurrent demand that Israel terminate its military activities in the Gaza Strip and remove its troops from the entire Gaza Strip,” continues Kisla.
